Personal Injury and Death - Selecting an Attorney

How to Choose the Right Lawyer

After an accident, it is important to find experience legal representation to ensure you are properly compensated. Choosing the right lawyer can be confusing. How will you know who is the best fit for your needs and your case? How do you know they will get you the best results possible? You are right to answer these questions, because all attorneys are not created equal.

Here are some tips to help you select an attorney who is right for you.

Free Consultation:

Personal Injury Attorneys usually provide free consultations, whether at their location or yours. This is an excellent time to get a feel for the possible rapport between you and your attorney. It will also give you a chance to hear how they handle cases such as yours. The Law Offices of Casey W. Stevens always uses this time as an opportunity to educate our new clients on the process of case handling. It allows them to know what to expect from beginning to end.

Qualification:

Obviously it is important to ensure your attorney is a member of the Georgia Bar Association in good standing. Length of experience matters, if they are going be the sole practitioner on your case. Ask your potential attorney to share with you some of his/her more recent cases and their outcomes. They should be able to reference several cases without hesitation.

Personal and Professional Service:

Although attorneys rely on their legal staff to carry out daily tasks relating to a client's case, the attorney you select should be the attorney who handles your case for all official legal matters. It is also important to hire an attorney who returns phone calls promptly, and is able to answer your questions thoroughly and easily. This requirement applies to their legal assistants as well. During the first few weeks of representation, you should have a good feel for how responsive your attorney's office is. This would be the best time to consider whether you want to continue allowing them to represent you. Read the contract before signing, and make sure there is a clause allowing you to discontinue representation if not satisfied with your attorney's performance.

Depth of Knowledge in Personal Injury Law:

Make sure that the attorney has handled many similar cases in the past. An attorney who advertises they handle family law or criminal cases might not always be the best person to handle your auto accident or product liability claim. At The Law Offices of Casey W. Stevens, we are able to show clients an extensive case list dating back for several years that represents former personal injury and wrongful death clients. All clients, we might ad, that we still remember. Many of them we still hear from today.

Fees:

Most of the time, injury and death cases are handled on a contingency fee basis. This means, if they are not able to secure compensation for your case, you will owe them nothing for their services. Be sure your attorney has some language pertaining to contingency fees in their contract.

It is important never to hire an attorney who contacts you before you have contacted him (AKA ambulance chasers). This behavior is unethical and should be reported to the Georgia Bar at once.

Personal Injury Attorneys - When do I need one?

We often have new clients come in who are nervous about being in an attorney’s office. They are typically getting over injuries, or dealing with the loss of someone they love. They really just can’t believe they’ve been put in the position of having to hire an attorney, and some are even embarrassed. We understand. Some say, “Mr. Stevens, we are religious people and really haven’t ever believed in suing people.” Others will say “We’ve really never considered ourselves to be litigious people, because life is just the luck of the draw.” Remember, if the insurance companies were paying people fairly for their losses, then there would be no need for Injury Attorneys. Period. So the people I have used as an example above, and hundreds of others have come to our firm for the same reason: to get fair compensation for the injuries they have sustained, without having to fight a system full of red tape, dishonesty and frustrations.

When you call The Law Offices of Casey W. Stevens, we will ask you for some details about the accident in which you were involved. These questions include:

1. The and date of the accident.
2. If a vehicle or boating accident, if any of the parties were charged.
3. The nature of the injuries.
4. The types of treatment received or required.
5. Pre-existing conditions.

Generally speaking, if another party was at fault, and if injuries were suffered as the result of the accident, you may need an attorney. Based upon the answers you provide to our practice, we will determine whether our assistance may improve the outcome of your case. We will not take on a case if we feel the client will receive better results on their own. And, we take it one step further. If we feel our services are not the best fit for your case, we’ll offer you a referral to one of a few hand-selected attorneys who all perform at the standard of excellence you expect.

After the initial phone consultation, we will set up an appointment to begin the process of pursing a fair recovery. All clients of Casey W. Stevens are seen by our principal attorney, and never a client intake specialist or junior associate. Our clients are never asked for retainers or for other forms of payment. We are paid for the work that we do out of the recovery we obtain for our clients. This is great for you, because you will have no out-of-pocket expenses while waiting for your case to be resolved. It is also great for you because it incents us to get you the best settlement possible.

What should I do after an accident?

Don’t wait for the insurance adjuster to tell you what to do. The better job you do of securing witnesses and documenting events, the better outcome you can expect with the assistance of an attorney. Dealing with claims adjusters is often where our clients go from trying to handle their own cases, to having us handle it for them. Remember, insurance adjusters are paid to deny or reduce claims….especially if those claims include medical expense, pain, loss of enjoyment of activities, and lost wages.

Do not ever sign off on a settlement with an insurance company unless you have been fairly compensated for all of the items above. Make sure you hire an attorney within the two years statute of limitations (meaning the time limit you are allowed to file a law suit.) Finally, make sure you hire an experienced attorney who will handle your case personally, return calls promptly, and focuses their area of practice on personal injury and wrongful death litigation.

Boating and Maritime Accidents

The Law Offices of Casey W. Stevens has access to maritime experts who specialize in analyzing boating accidents. We handle boating accident cases all over the country, including as far away as Arizona. As with all other injury cases, we do not collect fees from the client until the client has received a settlement.

According to the Georgia Department of Natural Resources, there were eighty-six watercraft related injuries and eleven fatalities on Georgia Lakes in 2008. Many of these injuries and fatalities were alcohol-related. Others were due to other types of negligence, which include not following boating laws, or having an unsafe vessel. The result of these errors includes boats and personal watercraft (PWC) colliding with each other, with someone in the water, or an occupant falling overboard.

Georgia has just over 192 miles of coastline on the Atlantic Ocean. These waters are also the home to boating and other maritime accidents. Cruise ships, barges, commercial fishing vessels and the like make their way up and down the Georgia coastline every day. Employees, guests and other occupants of these vessels expect the vessels are in good operating condition, and are being handled within the safety guidelines set forth for each of them. This includes operating the vessel in safe weather conditions.

When a vessel is not in proper operating condition, it may be caused by the negligence of the manufacturer, the owner, or in many cases the marina that rents the boat to another party. Determining this and other types of negligence require an attorney who has experience handling these types of cases.
